Terms and Conditions of Use

1. Acceptance of Terms
By downloading, installing, or using the RUTHY mobile application (hereinafter "the Application"), developed and operated by AUDORA TECH SAS ("AUDORA", "we", "us"), you agree to be bound by these Terms and Conditions of Use (the "Terms"). If you do not agree with these Terms, do not use the Application.
2. Service Description
RUTHY is a mobile application that provides audio guides and geolocated digital content for historical and cultural tourism. The Application allows users to explore cities through audio guides, interactive maps, and additional content that can be downloaded for offline use once unlocked through in-app purchases. The availability of features or content may vary by country, device, or Application version.
3. License to Use
AUDORA grants you a limited, personal, non-exclusive, revocable, non-sublicensable, and non-transferable license to use the Application on your mobile device, solely for personal and non-commercial use, in accordance with these Terms. You may not: (a) copy, record, download, reproduce, distribute, publish, sell, resell, rent, or lend the Application or its content, including audio guides, texts, images, or maps; (b) extract, capture, record, or share the Application's content on social networks, web platforms, messaging, or any other medium; (c) create derivative works, products, applications, or services based on the Application or its content; (d) reverse engineer, decompile, or attempt to access the source code; (e) use the Application for illegal, fraudulent, or unauthorized purposes; (f) remove, alter, or obscure copyright or property notices; (g) use bots, scripts, or automated tools to interact with the Application. AUDORA may revoke your license and suspend or cancel your access if you breach these Terms.
4. Intellectual Property
All rights, titles, and interests in the Application and its content (audio guides, scripts, texts, images, maps, design, interface, code, trademarks, and logos) are the exclusive property of AUDORA TECH SAS or are used under license from third parties. Use of the Application does not grant any intellectual property rights. The content is protected by intellectual property laws and unauthorized use may be subject to legal action.
5. User Account
To use certain features, you may need to create an account through external authentication providers (Google, Apple, or Facebook). You are responsible for maintaining the confidentiality of your credentials and all activities performed through your account. You must notify us of any unauthorized use. AUDORA may suspend or cancel accounts in case of breach, fraud, or activities that may harm AUDORA or other users.
6. In-App Purchases and Digital Content
The Application offers in-app purchases to unlock cities and additional content. Payments are processed exclusively by Apple App Store or Google Play Store. AUDORA does not have access to payment data. Refunds must be requested directly from the corresponding store according to their policies. In the case of digital content (such as downloadable audio guides), the user may lose the legal right of withdrawal once the content has been supplied or made available, according to applicable law. Nothing in these Terms limits the inalienable rights you have as a consumer in your country.
7. Acceptable Use
When using the Application, you agree not to violate laws, not to interfere with the normal operation of the service, or attempt to access accounts or systems that do not belong to you. You agree not to engage in activities that may damage, disable, or overload the Application or associated systems.
8. Geolocation and Physical Safety
The Application may use geolocation services to display points of interest and activate audio guides. You must use the Application paying attention to your surroundings and respecting traffic safety rules and common sense. AUDORA is not responsible for accidents, injuries, or damages resulting from the use of the Application while moving or in risky situations.
9. Service Availability and Modifications
We do not guarantee that the Application will function without interruptions or errors. We may modify, update, suspend, or interrupt the Application or parts of it at any time, except when applicable law requires otherwise. We may also update content (audio guides, images, maps, texts) for editorial, technical, or legal reasons.
10. Limitation of Liability
To the maximum extent permitted by applicable law: (a) the Application and its content are provided "as is" and "as available"; (b) AUDORA does not guarantee absolute accuracy of historical or tourist information; (c) AUDORA shall not be liable for indirect, incidental, special, consequential damages, data loss, loss of profits, or any damage arising from the use or inability to use the Application. Nothing in these Terms excludes liability when the law does not allow its exclusion, as in cases of willful misconduct or gross negligence.
11. Governing Law and Jurisdiction
Unless the mandatory legislation of your country provides otherwise, these Terms are governed by the laws of the Republic of Argentina and any dispute shall be submitted to the courts of the City of Córdoba, Argentina. If you are a consumer resident in the European Union or another jurisdiction with mandatory consumer rights, those rights are not affected by these Terms.
12. Modifications to the Terms
We may modify these Terms at any time. Significant changes will be notified through the Application or by email. Continued use of the Application after the effective date of the changes implies acceptance of the updated Terms.
